On June 28, 2013, a San Jose, California jury awarded $1,126,214.63 to a man who was hit by a car while riding his motorcycle. Panish | Shea | Ravipudi LLP attorneys Adam Shea and Patrick Gunning represented the plaintiff at trial.
Plaintiff Thomas Barbarito was driving his motorcycle in the City of Campbell on March 16, 2011 when a car driven by the defendant made a sharp right turn from the far left lane across two lanes of traffic. Mr. Barbarito, who was driving in the far right lane, was hit by the defendant’s vehicle and thrown to the ground. Mr. Barbarito suffered a left hip fracture and left clavicle fracture, among other injuries.
At trial, the defendant disputed the extent of Mr. Barbarito’s injuries and the cost of his future medical care. The jury disagreed, awarding the entire amount of medical expenses sought by the plaintiff in addition to non-economic damages.
