A new report finds an officer with the California Highway Patrol addressing some of the potential misconceptions surrounding cellphone driving laws throughout the state. He first points out that someone at the wheel of a parked car would be able to use their cellphone without fear of being ticketed, provided that they have moved out of an area where they could be seen as as blocking the flow of traffic. You also can’t just pull over onto the shoulder of a highway to make a phone call or send a text. The protections afforded to parked vehicles are not extended to individuals stopped at red lights or persons that are using the GPS functions on their handheld phones. However, the officer notes that dedicated handheld GPS devices are still technically legal.
