In Stewart v. Westcoast Bulk Transportation, Inc. – Panish | Shea | Ravipudi LLP attorneys Tom Schultz and Spencer Lucas, along with co-counsel Curtis Floyd of Floyd & Horrigan, obtained a $5,000,000-policy limits settlement following closing arguments at trial for the family of a man killed when he was crushed by a tractor-trailer while performing an inspection at a cement plant. The decedent had stepped in between two of the truck’s trailers when the driver moved forward without honking his horn or adequately inspecting for pedestrians. The defendant alleged that the decedent was at fault, including because he was distracted by a cell phone conversation, but evidence elicited at trial suggested that the cell phone found in the decedent’s hand may have been planted.
