Attorneys Brian Panish and Spencer Lucas of Panish | Shea | Ravipudi LLP will begin trial today in the matter of Margaret Jerich v. City of Glendale. The 90-year-old Plaintiff was struck and nearly killed by a City of Glendale garbage truck while she was crossing the street in a marked crosswalk with the aid of her walker on October 22, 2015.
Attorney Michael B. Goldstein also represents Ms. Jerich in the case.
Although police officers and the forensic team investigating the accident determined the trash truck driver was exclusively at fault, the City of Glendale initially blamed Ms. Jerich for the accident and fought liability until just prior to trial when the city conceded responsibility for the collision.
Ms. Jerich had the right of way in the crosswalk when she was struck and injured by the city truck. As a result of the accident, the elderly pedestrian suffered a femur fracture, as well as a severely crushed and mangled left arm when the extremity was run over by all three axles of the garbage truck.
Prior to the accident, Ms. Jerich had worked for 50 years as a registered nurse with the Los Angeles Unified School District and was living independently, walking up to two-miles each day. Now, the once active senior remains confined to a wheelchair, unable to walk with chronic pain syndrome and is living in a rehabilitation facility.
