PSBR attorneys Robert Glassman and Nathan Werksman, alongside co-counsel Nia Killebrew of Richard Harris Law Firm, obtained at $5,500,000 settlement for a man severely injured in a near head-on collision with a commercial truck.
Plaintiff Shahin Pourbayat was driving northbound on SR-113 in an unincorporated area of Sutter County, California when a Garden Highway Mutual Water Company truck, driven by defendant Jacob Dale Duffey and traveling in the opposite direction, unsafely crossed a double yellow line and crashed nearly head-on with Mr. Pourbayat’s vehicle.
As a result of the collision, the 31-year-old man suffered severe injuries including head trauma and injuries to his neck, back, knee and shoulder and ultimately underwent surgeries to his knee and shoulder.
Garden Highway Mutual Water Co. claimed that Defendant Duffey was not in the course and scope of his employment at the time of the accident. For nearly three years, Defendants fought liability despite the investigating officer’s determination that the defendant driver was solely at fault for the collision. Defendants also disputed the nature and extent of Mr. Pourbayat’s injuries but ultimately agreed to settle the case for $5,500,000.
