Panish | Shea | Ravipudi LLP attorneys Adam Shea, Patrick Gunning and Nicholas Yoka obtained at $4,500,000 settlement for the families of two men who were struck and killed by a driver on a California freeway following a collision with a drunk driver. Defendant Doe was driving drunk at approximately 87 mph when their vehicle collided with a truck, causing the driver to lose control of the vehicle and crash into the center divider, leaving both vehicles disabled. A Good Samaritan stopped to assist and approached the wreckage. Minutes later, another speeding vehicle struck the disabled truck and its occupants, who were now standing on the freeway, and pushed the disabled truck into the Good Samaritan, killing the decedents.
Defendant Doe’s policy limits were demanded prior to litigation. Defendant and their carrier disputed liability and causation. On the eve of trial, Defendants agreed to pay $4,500,000 to resolve all claims. PSBR successfully obtained this result against Defendant Doe despite the fact that a separate vehicle struck and killed the decedents.
