On March 26, 2019, Plaintiff Matthew Hibbard was operating a self-propelled Razor scooter near his home when the driver of a fully loaded concrete mixer failed to yield to his right-of-way while he was making a right hand turn. Mr. Hibbard entered an unmarked crosswalk on his scooter and proceeded to cross the street towards the other curb when he was struck by the concrete truck making a right turn and became pinned underneath. As a result of the collision, the 41-year-old man suffered crushing injuries to his right foot, including multiple toes being severed, which resulted in a partial lower leg amputation of his right foot below the knee.
Defense counsel contended that Mr. Hibbard was traveling at a high rate of speed on his scooter at the time of the collision and entered the intersection suddenly and directly in front of Defendant’s vehicle. Defendant also contended that the Defendant driver had already begun his turn prior to Mr. Hibbard passing in front of the concrete mixer, and that he was turning at a slow and safe speed when the collision occurred.
