The Daily Journal has released its list of 2021 Top Verdicts in California and named PSBR case Jane Doe v. Fitness Alliance among the largest and most significant verdicts in the state. The $13,000,000 verdict was rendered following a full day of jury deliberation in Riverside County Superior Court and included $5,000,000 in past non-economic damages (mental suffering and emotional distress) and $8,000,000 in future non-economic damages.
The notable result was obtained by firm partner Spencer Lucas and attorney Nadine Khedry for Plaintiff Jane Doe, for a 5-year-old girl who was sexually molested by a 13-year-old boy while in the care of EōS Fitness’ Kid’s Club in Palm Springs, California.
The $13,000,000 verdict, all non-economic damages, is very large for a “one-episode touching case.” In an interview with Daily Journal, Spencer shares that he believes the verdict should send a message to the entire fitness industry. “If they’re going to be running a child daycare, there needs to be training and awareness about the dangers of child sex abuse.”
Doe v. Fitness Alliance is one of only 47 cases throughout the state selected as a Top Verdict in California in 2021.
