How Do Courts Calculate a TBI Settlement?

With this method, the jury multiplies a daily pain and suffering amount (often equivalent to the victim’s previous daily wage) by the number of days he or she will presumably deal with the effects of the injury. Both methods will require an analysis of related facts and evidence, such as the victim’s medical records and expert testimony.
