Case Synopsis:
Spencer Lucas, Marguerite Sanvictores and Nadine Khedry obtained a $7,500,000 settlement for the husband and parents of a 34-year-old woman who was killed when a 40-foot decayed tree fell onto her car, crushing it, as she was backing
out of the carport attached to Waterstone Garden Apartments.
Plaintiffs contended that Defendant, as the owners and controllers of the subject apartment complex, had a duty to maintain the premises — including the subject eucalyptus tree — in a reasonably safe condition. The subject tree presented a “hidden trap” and dangerous condition to tenants, including the decedent.
